New York Law Firm Anelli Xavier, announces recent favorable outcomes for Albany clients charged with Driving While Intoxicated (DWI).

In one recent case, People vs. J.B. (Town of Halfmoon Court, Case #11-0328), the client was charged with three felony counts of DWI, including one count of Aggravated Driving While Intoxicated. Client was alleged to have a BAC of a .19, more than twice the legal limit. Moreover, this client had been convicted of a DWI within the previous 10 years, increasing the current charge to a felony, which is punishable up to four years in state prison. After extensive negotiations with the DA's office and pretrial hearings, the firm was unable to come up with a resolution that was acceptable to the client. Since the client was an Army veteran who served in Iraq, he could not plead to a felony and continue on the career path that he had chosen. Following negotiations, the trial team successfully argued that the client was not in fact driving at the time that the prosecution alleged. After a four-day trial, the jury found the client not guilty of all charges. This result allowed him to avoid any criminal conviction, incarceration, or probation.

In another case, People vs. D.B. (Town of Rotterdam Court, Case #12-0404), the client was charged with one count of misdemeanor DWI, having refused to supply a breath sample when arrested. He was alleged to have hit a telephone pole and then driven away with damage to the front of his truck. The offer extended by the DA?s office was to plead guilty to the crime as charged. The prosecutor stated that the client did not deserve a reduction as he had previously been convicted of two drinking and driving offenses and then during this incident was involved in an accident and refused taking a breathalyzer. The firm suggested that the client undergo treatment, given his obvious issues with alcohol and driving, and that if he was able to successfully participate in real treatment, that he be offered a reduction to a DWAI. The prosecutor appreciated the fact that we were taking the issue seriously and seeking ways to correct the behavior and gave the firm the offer of a DWAI based on participation in sanctioned treatment.

In a third case, People vs. M.D. (Albany City Court, Case #12-0054), the client was charged with a DWI and failure to stop at a stop sign. The prosecutor could not offer a reduction to our client based on the county policy of not reducing charges of anyone alleged to have refused the breath test. However, the client was adamant that he was not guilty of DWI and insisted that he would not plead guilty to anything other than Driving while Ability Impaired (DWAI), a traffic infraction. A member of the trial team handled a probable cause hearing, where the team was able to elicit valuable testimony that was favorable to our client. The attorney was then able to use this testimony at the subsequent trial of our client. At the trial, the client was found not guilty of DWI, a misdemeanor. He was convicted of DWAI and failing to stop at a stop sign, both traffic infractions. This allowed the client to maintain a clean criminal history and avoid having to install an Ignition Interlock Device on any vehicle that he owned or operated.

(AP) ? Sometimes it's better to dream, particularly when reality means you're not an instant multimillionaire.

Bob Kangas realized Wednesday night that one of two winning Powerball jackpot tickets ? a record $587.5 million ? had been bought in Arizona, but he didn't check his numbers.

"I didn't want to look because I just wanted to dream about being rich," Kangas said Thursday while checking his tickets at a 4 Sons Food Store in Fountain Hills, the suburban Phoenix shop where he bought his tickets ? and where the winning ticket was sold.

While lottery officials in Missouri verified its state's ticket after it was presented to them late Thursday, the Arizona winner had yet to come forward. They have 180 days to do so.

A news conference was planned for Friday morning in Missouri. Officials declined to provide details of the winner in advance, not even whether the ticket sold at a Trex Mart gas station in Dearborn was purchased by someone from that state.

Kangas just wanted one night to believe he could soon have more money than he'd know what to do with.

"I just wanted to dream all night," he said, breathing a heavy sigh as he realized his tickets were not winners. "I'll try again."

In Missouri, speculation had many of Dearborn's 500 residents buzzing about who had won.

Cashiers Kristi Williams and Kelly Blount greeted customers with big smiles and questions about whether they had bought the winning ticket.

"It's just awesome," Williams said. "It's so exciting. We can't even work."

Karen Meyers, a server at the Cook's Corner Cafe, said she didn't believe it at first when she heard the winning ticket had been sold nearby.

"I think it's wonderful! I hope someone local won it, not someone just passing through," she said. "It's a small town where everyone is really nice."

Kevin Bryan bought his ticket at the Trex Mart and made an extra trip to his mother's home in Dearborn to verify that the ticket he left on her counter wasn't, in fact, the winner.

"When I heard it was sold here in Dearborn I about fell over," Bryan said, as he hung Christmas lights outside his mother's home.

He said the only other local lottery win he could remember was when an area farmer won about $100,000 in scratch-off game years ago "and bought himself a combine."

Baron Hartell, son of the owner of the Missouri store, said if the winner isn't a local resident it might have been a truck driver. Interstate 29 is a busy thoroughfare connecting Kansas City to the Canadian border.

"Even the truck drivers who come around, we see them every day, so they all feel like all locals to us," he said.

Store manager Chris Naurez said business had been "crazy" for Powerball tickets lately and that the store had sold about $27,000 worth of tickets in the last few days.

"This really puts Dearborn on the map," he said.

Trex Mart General Manager Kenny Gilbert suggested his staff would be sharing in the $50,000 bounty that the store will be awarded for selling one of the winning tickets.

"The response from the owner was, 'I guess we'll be able to give out Christmas bonuses,'" Gilbert said. "That's nice, especially at this time of year."

The Phoenix shop will receive a $25,000 bonus but store owner Eric Seitz said it hadn't yet been decided what to do with the money.

Customers poured in to check their tickets and share in the big moment as media swarmed the small gas station.

"I think it's crazy, and I also think it's great," said store manager Bob Chebat. "I'm glad that all that work yesterday wasn't for nothing."

The store was swept up in a nationwide ticket-buying spree preceding Wednesday's drawing, with the big money enticing many people who rarely, if ever, play the lottery to buy a shot at the payout.

"There was a lot of traffic. We did a little over $8,000 worth of Powerball tickets just yesterday alone," said 4 Sons District Manager Harvey Frausto.

The numbers drawn Wednesday night were 5, 16, 22, 23, 29. The Powerball was 6. The huge payout represents the second-largest jackpot in U.S. history, and the largest for Powerball.

Tickets sold at a rate of 130,000 a minute nationwide ? about six times the volume from a week ago. That pushed the jackpot even higher, said Chuck Strutt, executive director of the Multi-State Lottery Association. It rolled over 16 consecutive times without a winner.

The lucky ticket-holders could split a cash payout of $384.7 million before taxes, or about $192 million each.

In a Mega Millions drawing in March, three ticket buyers shared a $656 million jackpot, the largest lottery payout of all time.

PHILADELPHIA (CBS) ? ?I like to kill ?em softly ?- from a distance,? says the reluctant assassin played by Brad Pitt.

Killing Them Softly, the crime drama he fronts, takes the same approach.

This will please viewers who admire the ambitiousness of a genre item with something on its mind beyond the machinations of the plot, and perhaps displease aficionados of gritty, action-oriented crime thrillers.

This particular crime thriller is set in the shadow of the transition between the Bush administration and the Obama administration in 2008.

Yep, 2008 ? the year when the economic collapse affected everyone, including America?s gangsters.

Brad Pitt stars as Jackie Cogan, a hired hitman and mob enforcer who is contracted to rub out a couple of hapless hoods who had the nerve and misfortune to rob a mob-protected poker game in an unidentified American city run by Markie Trattman, played by Ray Liotta.

Markie is a suspect as well, so Jackie is instructed to take him out too.

Jackie is hired by Richard Jenkins, who plays the mob?s accountant and liaison to the bosses who protect the game.? But because Markie is a friend of Jackie?s, he begs off and the job is given to another hitman, played by James Gandolfini.

Can?t tell the players without a scorecard!

This is not a standard crime thriller from New Zealand-born Aussie writer-director Andrew Dominik (Chopper and The Assassination of Jesse James by the Coward Robert Ford, starring Pitt), whose darkly comic screenplay is an adaptation of the 1974 George V. Higgins novel, Cogan?s Trade.? The film has cerebral ambition but a certain degree of intellectual pretentiousness ?- and relentlessness ? as well.

Perhaps it makes a bit too much of the surface similarities between the mob?s gambling problems and the nation?s financial crisis.? Perhaps it doesn?t quite earn its right to the capitalist critique.? And perhaps too much of the text ought to be subtext.

But the splendid dialogue, razor-sharp and true to the environment, at least makes you listen.? And want to.

The governing metaphor that Dominik offers is the maneuvering within a criminal syndicate standing in for the current state of our economy.? So the narrative?s ultimate focus is on recession-era crime and its consequent punishment.? Or, more to the point, lack thereof.

Throughout scene after scene of desperate lowlife criminals behaving to advance the generic plot, we notice in the background, coming from radios and television screens, elements of the 2008 political campaign in which Bush, Obama, and McCain offer false hopes for emerging from our economic crisis.

Pitt contributes a thoughtful, world-weary, low-key turn as the antiheroic, cold-blooded protagonist, dialing down his natural charismatic presence so as to fit in without sacrificing his authoritativeness.

And the ensemble really seems to relish delivering their crackling and often funny dialogue.

So we?ll mob 2? stars out of 4 for the cynical and engrossing gangster thriller, Killing Them Softly, a thinly disguised critique of the current state of declining American capitalism that is also criminally entertaining.

ULA pre-budget statement calls for debt repudiation & higher taxes ...

United Left Alliance proposes abolition of USC for those earning less than 40,000, end to home-taxes and reversal of cuts in health, education and social welfare

At a press conference today, the ULA proposed a socialist alternative to the budget proposals of the government and the other parties in the D?il. The ULA pre-budget statement says that those who are responsible for the crisis should pay for it, not those who are the social and economic victims ? the ordinary working people of Ireland.

The ULA proposes to take the burden of the crisis off working people, improve their lives and revive the Irish economy. This can only be done by taking the decision-making of the banks and finance houses out of the hands of management whose only goal is profit; and embarking on a major public investment program. If the current investment rate of 10% of GDP (EU average is 18.5%) continues, Ireland will become an economic backwater with impoverishment for generations and run down public services. Only a reversal of current policies can stop that.

The ULA proposes to repudiate all debt deriving from the financial crash that started in 2008 and raise additional revenue from increases of income tax on the richest in society; to introduce a wealth tax and a financial transaction tax; and to impose a minimum effective rate of 12.5% corporation tax, with a nominal rate of 15%.

The following are some of the measures being proposed.

Deficit, expenditure and revenue-raising measures:

The primary deficit for 2013, without the ?9.1 billion debt-interest payment and without the government?s proposed cuts and tax increases would be ?6 billion. Interest payments on the remaining debt after repudiation: ?1.6 billion. Reversal of cuts: ?3 billion.

Total deficit to be closed: ?10.6 billion

Revenue generating measures:

  • Corporation Tax: ?5 billion
  • Wealth Tax: ?2.8 billion
  • Financial Transactions Tax: ?0.5 billion
  • Income Tax: ?2.5 billion

Total:?10.8 billion

Public Investment Program: net cost ?15 billion over three years.

Redirect money held by Irish banks to pay bondholders (?17.4 billion available for 2013 alone) to a Jobs Fund. Other sources: a Jobs Bond, NPRF investment, pension funds and Credit Unions.

Don?t pay the debt ? It?s not ours!

The ULA proposes to write down the national debt to pre-crash levels and halt all debt-interest payments incurred as a consequence of the crash.

Writing down the Irish debt to the pre-crash figure of ?47.4 billion would reduce debt-interest toapproximately ?1.6 billion next year ? at an interest rate of about 4%.[1]

Repudiating the debt would also mean cancelling the planned ?3 billion in annual payments to Anglo-Irish Bank and any further payment of debts to bondholders in BOI, AIB or other private banks. These amount to ?17.4 billion in 2013, ?5.9bn in 2014, ?11.6bn in 2015[2]

Increase total income tax-take on the wealthiest 5% by ?2.5 billion

Through a combination of graduated tax bands for incomes in excess of ?100,000 (50%),?150,000 (60%), ?200,000 (70%) and the establishment of a sliding scale of new minimum effective tax rates on incomes over ?100,000 per year, the ULA proposes to increase the annual tax take from this group by ?2.5 billion.

Introduce a ?Millionaires Tax? to raise ?2.8 billion in 2013; set up a wealth and assets register.

Central Bank data for Quarter two of 2012[3]show that there were ?446.4 billion worth of net assets, when debts and liabilities are subtracted. A 5% wealth tax on assets in excess of ?1 million would raise ?2.8 billion in 2013.

Introduce a Financial Transaction Tax.

A tax on bond and share trading of 0.1% and on derivatives of 0.01% would raise an estimated ?500 million.

Impose an effective corporation tax rate of 12.5%, rising to nominal 15%

In 2010 companies registered in Ireland declared pre-tax profits of just under ?70 billion but only paid ?4.2 billion in tax ? an effective rate of below 6.5%. An effective rate of 12.5% would raise ?4 billion and an increase to 15% would raise another ?1 billion. Total: ?5 billion.

Take full control of the banks.

Irish banks are among the best capitalised in Europe due to their bail-out. AIB is already 99% state-owned and Bank of Ireland is 15% state owned. We propose full nationalisation with direct public control of the banks and finance institutions, including their mortgage portfolios, without compensation except on the basis of proven need.

Write down mortgage debt

Resolve the mortgage crisis through a write-down to current market value of owner-occupier mortgages given out between 2002-2008. The banks have been given money to cover losses on mortgages. Any shortfall should be covered by non-payment of bondholders. Remove the bank veto in personal insolvency legislation; enshrine in law protection of the family home; no repossessions.

Lend to small businesses ? differential rates and rent controls

Bring in a progressive system of differential rates based on profitability; end upward only rent reviews; bring in rent controls. Increase credit for small businesses and farmers through democratic public ownership of the banks.

?24 billion public investment to directly create 180,000 jobs ? net cost ?15 billion

The current investment rate of 10% of GDP a year will turn Ireland into an economic backwater, with continued unemployment around 15% and mass emigration. Private investment has dried up ? down ?32 billion a year since 2007.

A?24 billion investment program over three years would put 180,000 directly to work. At wages of ?35,000 it would cost ?2.7 billion p/a on top of current jobless benefits. Indirectly another 120,000 jobs would be created ? a total of 300,000. The net cost to the state after three years would be ?15 billion, as a result of the increased tax revenue and higher GDP.[4]

Funding would come from the ?17.4 billion the banks have for bond payments; from the launch of a Jobs Bond; from social investment by the Credit Union movement; from investment by Irish pension funds; and from the NPRF.

A three-year program of state-built housing provision ? costing ?3 billion per year but self-financing over 10 years.

Provide 100,000 new Council houses over three years using empty housing and new build; transfer all suitable empty housing to local Councils; build Council housing to meet needs and eliminate waiting lists; a new state construction company employing 30,000 to refit / build 33,000 houses per year for three years.

End the privatisation of state companies and the give-away of natural resources.

Estimates of the value of Irish oil and gas reserves range from ?420 billion to ?1500 billion. Current tax on the multinationals which extract it is the lowest in the world. Set up a state gas and oil company to develop reserves. Abolish current licences and re-nationalise all oil and gas reserves.

The government plans to sell off our state enterprises. We say stop all privatisations and renationalise of all privatised industries. Develop the economy and natural resources in an environmentally sustainable manner.

Abolish USC and Household Tax, and reverse the cuts. (cost ?2.9 billion)

* Abolish the USC for those under ?40,000 and reduce it by 50% for those earning between ?40,000 and ?70,000: cost ?2.5 billion.

* Abolish Household Tax. Cost: ?160 million.

?Lift the SNA caps ? train hire 5000 SNA?s resource teachers

?Reverse the cuts to disability, mental health and childcare services: ?50 million

?Reverse cuts in fuel allowance: ?51 million

?Re-instate the one million home-help hours: ?20 million

?Reverse the change to the income disregard for lone parents, restore entitlement to one parent family payment to 15years; restore the qualified child increase to those on CE schemes restore concurrent payments: ?20.7 million

?Reverse the cuts to CE schemes, Back to Education allowance and jobs initiative: ?35.9 million

?Reverse the cuts to rent supplement: ?55 million

?Reverse last two years increase in the current student contribution (registration fee):?33 million

?Reverse the reductions in 3rd level and postgraduate grants: ?15.4 million

Total cost of reversing cuts: ?2.9 billion

In a statement Richard Boyd Barrett TD said: ?The purpose of this pre-budget document is to nail the government lie that there is no alternative to continuously bailing out bankers and speculators and paying for it with endless and crippling austerity.

The simple fact is that government and Troika policies are crushing ordinary citizens, working people, the unemployed and vulnerable sectors of our society and strangling our economy. If the government moves ahead with the home tax and further austerity measures next Wednesday, hundreds of thousands of families will driven into poverty and our economy will be driven even further into a vicious downward spiral.

There is an alternative, if we stop paying out billions to bondholders and interest on unsustainable debts that have been loaded onto the backs of ordinary Irish people. If we repudiate these odious debts and impose higher progressive taxes on the very wealthiest in our society and on super-profitable corporations, we can relieve the burden on low and middle income families, stimulate the economy and finance major job creation programme.

Joan Collins TD said: ?By abolishing the USC for those earning less than ?40,000 and abolishing home taxes we can drag hundreds of thousands of families back from the brink of poverty and beath life back into our devastated domestic economy.

The government won?t do this because they are protecting the financial and millionaire elites. If we are going to implement a fair alternative, it will only only be done through a major movement of people power on the streets.

We are appealing to the public, who are the targets of the government?s vicious austerity policies to take to the streets on budget day and join the protests called by the Campaign Against Household and Water Taxes (CAHWT), the Council of Trade Unions and other community groups.?

Clare Daly TD, United Left Alliance said:

?More and more people in this country are struggling and wondering how they are going to pay their bills and put food on the table.

Imposing a property tax on people who can already barely make ends meet will have a disastrous effect.

Cutting child benefit will put enormous pressure on families. If people can?t spend how is the economy going to recover. What we need is an end to this austerity and get people back to work?

Commenting on the ULA?s pre budget statement Socialist Party/United Left Alliance TD for Dublin West Joe Higgins TD said: ?This statement for me is not about how I think the capitalist system should be run. The system itself is crisis and is failure from the point of view of working class people, low and middle income as well as the unemployed, pensioners and students. What the statement highlights is that economic activity as it is organised under this system continues to make a small minority obscenely wealthy and that if the economy was organised in a different manner the basis would be there to overturn the austerity and meet the needs of people. None of this, not the cancellation of the debt or the taxing of wealth, will be achieved by reasoning with the political establishment or the troika. Instead it has to be struggled for and if such a struggle takes place the resistance that would come from the rich to having their privileges challenged would make clearer to ordinary people the need for a fundamentally different type of society. For me that is a democratic socialist alternative to capitalist crisis.?

Mercury Contains Water Ice at its Poles

It may be the closest planet to the Sun, but even Mercury has water ice. A lot in fact?as much as 100 billion to 1 trillion tons, according to a trio of studies published today by scientists working with NASA?s MESSENGER orbiter. The findings, out today in the journal Science, are the first to give strong evidence of water in Mercury?s polar regions, following decades of speculation.

Using the neutron spectrometer aboard MESSENGER?which became the first spacecraft enter Mercury?s orbit in March?scientists detected unprecedented high concentrations of hydrogen within the craters in Mercury?s polar regions. Combined with the temperature models created from topographic data taken with the orbiter?s laser altimeter, and the researchers had their evidence: Pure water deposits on Mercury.

"If it was the neutrons alone, it would be harder to say, 'Bang, it's water ice,'" says David Lawrence, MESSENGER participating scientist. "But when you combine that with the radar data, the topography, thermal maps, they're all pointing to the same conclusion?it's got to be ice."

It may seem improbable that a planet where temperatures can register as high 800 F at the equator would have ice, but the surface of Mercury is one of extremes. Since Mercury?s rotational axis isn?t titled like the Earth's, craters within the polar regions of the planet are permanently shaded from the Sun?s rays, causing temperatures within their depths to sink as low as -370 F. That's certainly cold enough to retain any ice from a comet impact millions of years ago, Lawrence says.

While the recent discovery doesn't improve our understanding of how the planet initially formed?a topic that continues to confound scientists to this day?it does pose a new set of questions for researchers.

"In the planetary science community we've been living with this idea of water ice for 20 years," Lawrence says. "But the new questions are, how do we measure this is more detail? How deep does it go?" Further study into the ice will hopefully reveal the source of the ice?perhaps comet impacts?and it's extent. With enough fuel to last it until 2015, MESSENGER will give scientists plenty of time to find out.

As a home inspector and structural pest inspector I field funny calls at times.

Many people know or read that I am a structural pest inspector and with that think that I am an authority on all pests. Well unfortunately that is not true? I am not an authority on all pests. I cannot give you very good guidance on your little brother or a nosey neighbor or a host of other pests.

Structural pest are a select group of insects and organisms that will destroy the integrity of wood structural components. The main pests I am concerned with are termites, carpenter ants, moisture ants and Anobiid beetles. The other major concern is wood decay rot fungi. There are other wood destroying insects but are not very common in my area.

But what is true I can usually find answers for people and or give them direction on who to call.

Case in point, I get a call from an associate of mine and she was beside herself. She said ?I did not know who to call. I have flies all over my house and it is driving me crazy?.

After a little giggle we get down to helping her out with her house of flies.

Flies can be a nuisance for sure. But they are like many things an indication of something, usually that you have something dying and decaying in the home.

A little Fly-ology- The most common flies we will encounter are;


House fly- House flies are 3/16 to 1/4 inch long with robust bodies and two clear wings. The thorax is marked with four dark stripes. Larvae are called maggots and are creamy-white and cone-shaped, with the hind end blunt and bearing breathing holes (spiracles) tapering to the head which bears black hook-like mouthparts.

Female flies lay numbers of eggs in suitable larval food sources such as decomposing food in garbage, animal excrement or other decomposing organic materials. Development from egg to adult can be completed in about a week under optimal conditions. Adults normally live up to 25 days but may overwinter.

Little House Fly- They are generally most numerous during the cooler spring and fall months. Adults are approximately two-thirds the size of the house fly and are missing the house fly?s distinctive thoracic stripes. They rest hold their wings over the back more than the house fly does, creating a narrower V-shape to the wing outline.

Females like to lay their eggs in animal wastes (especially chicken manure), but various moist organic materials can serve as suitable nesting substances. Their developmental time from egg to adult is somewhat longer than for the house fly at all temperatures.

Garbage Fly- A group of fly species with similar life histories and behaviors. Adult flies in this group can be readily differentiated from other flies by their coloration, which is a shiny, metallic green or blue often mixed with some copper color.

These flies can develop from egg to adult in as little as 7 days. Eggs are usually laid in decaying meats, garbage, or dog feces. Similar to other nuisance flies, garbage fly larvae leave their developmental site to seek out drier and more protected areas for pupation.

Fruit Fly-There are many species of fruit flies, ranging in size from 1/32 to 3/32. They can be recognized by the rather bulbous shape of their lower bodies, which is frequently an orange or light brown color. They are relatively slow flyers, often hovering around fruit or juice. They have an excellent sense of smell and are strongly attracted by bananas.

Female fruit flies are capable of laying hundreds of eggs and develop from egg to adult in about a week. Eggs are most commonly laid on moist, fermenting food masses such as over-ripe fruit and vegetables.

The main elements of fly prevention are sanitation and exclusion, with sanitation always the first priority. ?The fewer flies that breed in an area, the fewer there will be indoors. So keeping garbage areas clean and take your garbage out frequently. ?Throw away any decaying fruits and organics. Also I was shown by an old glazier that ?Sprayaway? glass cleaner is an excellent flying insect knock down spray. Gotta love old glaziers. I saw this in action.

These insects have been known to carry over 100 different kinds of disease-causing germs, which makes them very bad house guests.
